The new UK "Highly Skilled" Tier will be launched in April 2011. This new type of visa has replaced the Tier 1 General Visa, which was known as the Highly Skilled Migrant Program (HSMP). Since December 23, 2010, the UK Border Agency has not accepted Tier 1 (General) applications from outside the UK.

Entrepreneurs, investors, and a small number of people with outstanding skills would be able to enter the UK under the new Highly Skilled Tier Visa. The new Tier 1 immigration system will prioritise entrepreneurs and noble scientists, artists, and athletes.

As a result, starting in April 2011, only a small number of entrepreneurs, investors, and skilled workers will be eligible to enter the UK under the new Highly Skilled Tier Visa.

New Proposed Immigration Changes announced by the UK Government

The UK government has explained the long-awaited and expected changes to the UK immigration system. According to the UK Border Agency (UKBA), the April 2011 changes would include a permanent immigration cap on skilled immigrants, a new exceptional talent visa, and new requirements for skilled workers with job offers and intra-company transfers. Significant modifications to the regulations for sponsoring non-EU workers would also be introduced.

It was announced that the Tier 1 General Skilled Immigration Visa would be phased out as of April 6, 2011, and that a new "Exceptional Talent" visa would be established in its place. The UKBA announced that beginning April 6, 2011, an annual limit of 1,000 visas will be issued for the "exceptional talent" visa category, while the yearly cap for Tier 2 visas is fixed at 20,700.

According to the UKBA, the total number of Tier 2 visas would be divided into 12 monthly quotas of 1,500 spots. Furthermore, after the certificate of sponsorship has been provided to the employer, it must be allocated to the prospective employer within three months. Under the proposed guidelines, employers would also be allowed to apply for a certificate of sponsorship from the UKBA for a specific position. Currently, sponsorship certificates are distributed on a yearly basis.

All non-EU employees would be eligible for the Tier 2 visa if they work in a graduate-level position in the UK, speak intermediate-level English, and fulfill specific income and employment standards.

Some modifications are also in the works for the Tier 2 visa intra-company transfer route, such as the requirement that applicants applying under this visa type work in an occupation on the graduate occupation list. In addition, if the worker plans to stay in the UK for more than a year, he or she must be employed in a job that earns more than £40,000 per year. Workers earning more than £40,000 per year are eligible for a three-year visa with the option of extending it for another two years.

However, there is no limit on the number of employees who can join the UK via the Tier 2 visa intra-company transfer route.

EEA Family Visa Basic Requirements:-

-To qualify for an EEA Citizen Family visa, there are certain prerequisites set by the UK Immigration Authorities that must be met.

-In the case of spouses or partners, the sponsor and the dependent must be at least 18 years of age and in a genuine relationship.

-In the case of other family members, the applicant must demonstrate that they are dependent on their EEA relative.

EEA Family Visa Entitlements

The validity duration of the EEA family visa differs depending on the information provided about how long the EEA family member would use their treaty rights in the UK. The maximum validity period is five (5) years.

On completion of five (5) years in the UK and satisfying the requirements, the EEA Family visa holder becomes eligible to apply for Indefinite Leave to Remain (ILR). ILR entitles individuals to permanent residency in the UK as well as visa-free travel to and from the UK. ILR holders may be eligible to apply for British citizenship and may also be able to sponsor their non-British relatives into the UK
